These Terms and Conditions set out the basis on which Waste Clearance Bloomsbury provides waste removal and related services within its service area. By making a booking or allowing our operatives to commence work at your premises, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below.

Customer means the individual, business or organisation requesting services from Waste Clearance Bloomsbury.

Services means waste clearance, rubbish removal, bulky item removal, garden waste removal, commercial waste removal, and any associated services provided by us.

Waste means any items, materials or substances that the Customer asks us to remove, subject always to applicable waste regulations and any exclusions set out in these Terms and Conditions.

Premises means the property or location where the Services are to be carried out.

We, us and our refer to Waste Clearance Bloomsbury, operating as a waste collection and clearance service provider in the United Kingdom.

2. Scope of Services

We provide waste clearance and rubbish removal services to domestic and commercial Customers. Our services include the loading, removal and lawful disposal or recycling of waste from the Premises, subject to any specific limitations agreed at the time of booking.

All Services are provided on the basis of information supplied by the Customer. It is the Customer’s responsibility to ensure that all information relating to the type, quantity and location of waste is accurate and complete.

We reserve the right to refuse to provide Services where carrying them out would, in our reasonable opinion, be unsafe, unlawful, uneconomical, or beyond the scope of what was agreed at the time of booking.

3. Booking Process

3.1 Bookings may be made by telephone, email or through any booking channel we make available. A booking is an offer by the Customer to purchase Services in accordance with these Terms and Conditions.

3.2 We will confirm acceptance of a booking verbally or in writing. A contract between the Customer and Waste Clearance Bloomsbury is formed only when we confirm acceptance of the booking and provide a scheduled date and time window for the Service.

3.3 When making a booking, the Customer must provide accurate details, including the address of the Premises, access arrangements, the approximate volume, type and description of waste, and any relevant restrictions such as parking limitations, building access codes or time restrictions.

3.4 Any quotations given prior to attendance at the Premises are based on the information provided by the Customer and are indicative only. The final price may differ once our team has inspected the waste on site.

4. Service Attendance and Access

4.1 We will use reasonable endeavours to attend the Premises within the agreed time window. However, times are estimates only and may be affected by traffic, weather, operational or other factors beyond our reasonable control.

4.2 The Customer is responsible for ensuring that we have safe and reasonable access to the Premises and to the waste to be collected. This includes arranging necessary parking, permits, or authorisations and ensuring that access routes are clear and safe.

4.3 If we are unable to gain access to the Premises, or if access is significantly impeded, we may charge a call out fee and either cancel the booking or rearrange the appointment. Any additional costs arising from restricted access, such as longer carrying distances or use of extra personnel, may be added to the final charge.

5. Pricing and Quotations

5.1 Our charges are generally based on the volume and type of waste, the labour involved, and any additional costs such as congestion, parking, or specialist handling requirements.

5.2 Any quote provided in advance of our visit is an estimate only and does not constitute a binding offer. Once on site, our team will assess the waste and confirm the final price before commencing work. If the Customer does not accept the final price, no work will be carried out and no charge will be made, save for any applicable call out fee if previously notified.

5.3 Prices are quoted in pounds sterling and are exclusive of any taxes that may apply unless otherwise stated. We reserve the right to amend our prices at any time, but any agreed price for a confirmed booking will not be changed, except where the description or quantity of waste differs materially from that originally advised.

6. Payments

6.1 Payment is due on completion of the Services unless agreed otherwise in writing in advance. We accept payment by cash, approved credit or debit cards, or other methods that we may make available from time to time.

6.2 For business Customers, we may at our discretion agree to provide Services on account. Where Services are provided on account, payment is due strictly within the payment terms agreed in writing. If no specific terms are agreed, payment must be made within 14 days of the invoice date.

6.3 If the Customer fails to make any payment on the due date, we reserve the right to charge interest on the overdue amount at the statutory rate and to recover any reasonable costs incurred in recovering the overdue sum.

6.4 We may suspend or cancel any further Services where sums are outstanding beyond the due date or where we reasonably believe the Customer may be unable to meet their payment obligations.

7. Cancellations and Amendments

7.1 The Customer may cancel or amend a booking by contacting us during our normal business hours. We request as much notice as possible so that we can rearrange our schedules efficiently.

7.2 If the Customer cancels a booking with at least 24 hours notice before the scheduled arrival window, no cancellation fee will normally apply.

7.3 If the Customer cancels with less than 24 hours notice, or if we attend the Premises and are unable to carry out the work due to circumstances within the Customer’s control, we may charge a reasonable cancellation or call out fee to cover our costs.

7.4 We reserve the right to cancel or reschedule a booking in the event of circumstances beyond our reasonable control, including but not limited to severe weather, traffic incidents, vehicle breakdown, staff illness or safety concerns at the Premises. Where possible, we will offer an alternative appointment at the earliest mutually convenient time.

8. Customer Obligations

8.1 The Customer warrants that they are either the owner of the waste to be removed or have the full authority of the owner to arrange its removal.

8.2 The Customer must ensure that no prohibited or hazardous items are included in the waste, unless we have expressly agreed in writing to handle such items in compliance with relevant regulations and any additional charges have been agreed.

8.3 The Customer must notify us in advance of any items or materials that may pose a risk to health, safety, property or the environment, including but not limited to chemicals, sharps, medical waste, asbestos, gas cylinders, or electrical equipment requiring specialist disposal.

8.4 The Customer must not cause or permit any of our employees or contractors to be exposed to abusive, threatening or unsafe behaviour at the Premises. We may suspend or terminate Services immediately if our staff are placed at risk.

9. Waste Regulations and Prohibited Items

9.1 We operate in compliance with applicable UK waste management legislation and regulations, including the duty of care for controlled waste. We will transport and dispose of waste only at authorised facilities and will take reasonable steps to ensure waste is reused, recycled or recovered where possible.

9.2 Certain items are prohibited or restricted and may not be collected as part of standard Services. These may include, without limitation, asbestos and asbestos containing materials, clinical or medical waste, certain chemicals, flammable liquids, explosives, radioactive materials, gas bottles, and some hazardous electrical equipment.

9.3 Where we discover prohibited or hazardous items that have not been disclosed in advance, we may refuse to remove them, adjust the quoted price to reflect necessary additional costs, or require the Customer to make alternative arrangements. We accept no liability for any delay, additional cost or inability to complete the Service arising from such undisclosed items.

9.4 If we reasonably believe that accepting certain waste would cause us to breach any law, regulation, permit condition or code of practice, we may decline to collect all or part of that waste and may terminate or amend the Service accordingly.

10. Ownership of Waste and Disposal

10.1 Ownership of waste transfers from the Customer to us once the waste is loaded onto our vehicle and payment for the Service has been made or agreed in accordance with these Terms and Conditions.

10.2 We will manage the waste responsibly following transfer of ownership, including transport, sorting, recycling, recovery or disposal through authorised carriers and facilities.

10.3 Once removed, waste cannot be reclaimed by the Customer. The Customer should therefore ensure that no personal possessions, important documents, or items of value are included in the waste. We do not accept responsibility for items mistakenly presented to us as waste.

11. Liability and Limitations

11.1 We will exercise reasonable care and skill in providing the Services. However, we will not be liable for any loss or damage arising from inaccurate or incomplete information supplied by the Customer, unsafe or defective structures at the Premises, or matters beyond our reasonable control.

11.2 We will take reasonable care when moving items on or from the Premises, but minor scuffs or marks to floors, walls or fixtures may occur, particularly where large or awkward items are being removed. The Customer should take reasonable precautions, such as protecting surfaces or removing obstacles, to minimise the risk of damage.

11.3 Our liability for damage to the Premises directly caused by our negligence shall be limited to the reasonable cost of repair or reinstatement, subject to an overall cap equal to the total price paid for the relevant Service. We shall not be liable for any indirect, consequential or economic loss, including loss of profit, revenue, business or anticipated savings.

11.4 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter that cannot lawfully be limited or excluded under UK law.

12. Insurance

12.1 We maintain public liability insurance at a level we consider appropriate for the nature of our operations. Details of our current cover can be provided on request.

12.2 The Customer is responsible for maintaining appropriate insurance for their own property and belongings, including any items which may be at risk during the provision of the Services.

13. Complaints

13.1 If the Customer is dissatisfied with any aspect of the Service, they should notify us as soon as reasonably practicable, providing details of the issue and any supporting information.

13.2 We will investigate complaints promptly and, where appropriate, may arrange a revisit, partial refund or other remedy, at our discretion and in line with our legal obligations.

14. Data Protection and Privacy

14.1 We will collect and process personal information about Customers for the purposes of administering bookings, providing Services, handling payments and managing our operations.

14.2 We will handle personal information in accordance with applicable data protection laws in the United Kingdom and will take reasonable steps to keep such information secure and confidential.

15. Termination

15.1 We may terminate the contract with immediate effect by giving notice to the Customer if the Customer commits a serious breach of these Terms and Conditions, fails to make payment when due, behaves abusively or unlawfully, or places our staff at risk.

15.2 On termination, the Customer must pay for all Services provided up to the date of termination, together with any applicable charges or costs incurred as a result of the termination.

16. Changes to These Terms

16.1 We may revise these Terms and Conditions from time to time. The version in force at the time of the Customer’s booking will apply to that booking and the related Services.

16.2 Any material changes will be made available through our usual communication channels. Continued use of our Services after changes take effect will constitute acceptance of the updated terms for future bookings.

17. Governing Law and Jurisdiction

17.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

17.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of our waste collection and clearance services.

18. General Provisions

18.1 If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

18.2 No failure or delay by us in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.

18.3 The contract for Services is between Waste Clearance Bloomsbury and the Customer. No third party shall have any rights under the Contracts Rights of Third Parties Act 1999 to enforce any term of this agreement.

18.4 These Terms and Conditions, together with any written confirmation of booking, constitute the entire agreement between the parties in relation to the Services and supersede any prior representations or understandings.
